Right guys as you know van is is shop for repair. Just had a call from marquis re engine fault they are hitting me with:
Van need to go to another garage for diagnostic to see what the problem is (could be clutch) but if it comes back ware an tear I need to pay for the diagnostic and the repair, I have had van 11 month done 5000miles
Advice needed is this right or do I fight it?

But surely you would not be expecting to replace a clutch at 31000 miles? The warranty does not cover ware an tear but I feel it is only 11 month old to me.

Well we don't whether the clutch is the problem, though that should be easily established and is the first step.
If the warranty doesn't cover wear and tear they might try to use it to exclude replacing the clutch. Does it say wear and tear by you? Regardless a clutch should last a lot longer than 31,000 miles given that you've only done 5,000 miles in it you could try arguing that, if it is the clutch, then it must have been on it's way out before they sold you the van.
Pin point the problem first. Doubtless Geoff will give some advice on the legal position.

It might be worth getting an AA or RAC Vehicle Report if there's going to be a debate about what's wrong and what can be reasonably expected to be "fair wear and tear". It's then not just Marquis arguing against you - it's them trying to argue againt the AA/RAC, and (God forbid) if it got to Court, their Report would be gold dust for you. I'd get the diagnostic done first and then gauge what Marquis' stance is. Take it further with a Vehicle Report then if necessary. I don't believe you need to be a member to have one done.

It's hard to figure out why anybody thinks it's the clutch but I had a 3 litre Fiat on which the clutch went at 15,000 miles. Though in my case it just started slipping, no smoke or anything like that. Fiat didn't want to know as they've never admitted to a fault on the 3 litre even though they did on the 2.3 where they modified them all free of charge. In the end the German garage were we had the work done told Fiat that the take up point was wrong (right at the top of the pedal travel as I recall) and they allowed the new one under warranty to cure that. However that doesn't get the dealer off the hook warranty wise. Don't get too hung up on the clutch till you know whether that's what the problem is. I'd ask for an independent test before it goes to a Fiat dealer. Jim's AA or RAC idea is a good one. Here's the story of our clutch replacement though we still don't know if your problem is the clutch: forums.motorhomefacts.com/31-base-chassis-fiat-mercedes-iveco-etc/51846-judder-new-clutch-fitted.html Reading that thread again after all this time it is clear that Fiat dealers were still diagnosing clutch faults on the 3 litre variant and that Fiat themselves were still saying that they were working out what they'd do to help with the problems owners of 3 litres were having. Subsequently that changed and Fiat just flatly denied that there was any fault. Dealers who had previously tested vehicles and agreed that there were faults now also changed their minds and denied it too.

afaik normally on brand new vehicles clutch and whole vehicle is covered for 1st year or so many miles. on second hand vehicles i thought you get minimal clutch coverage maybe 1 to 3 months,
would personally expect 50k + out of a new clutch but thats with me driving, its very possible to burn them out very quickly but i wouldnt think as quickly as 5k
cant see wear and tear being applicable at 11 months

We bought a secondhand Clio (56 reg) for the Grandson a few weeks ago. The Garage said they would give a 3 month warranty but would exclude the clutch because he had just passed his test and could possibly mangle a good clutch. We agreed to this as sometimes you just have to trust people. I was happy enough because I had driven nothing else but Clios for 13 year and found them very reliable.
