I'd pay it under protest and then look at going after them in the small claims court. My understanding is that the replacement clutches use a different (softer?, I know that sound odd at first glance) friction material. If that's true (and it may be possible to establish that it is) it's an admission the the original was too hard and was likely to cause slipping and over heating. Just a thought. Ask to keep the old parts because if you want to try that you'll need to show that it wasn't wear and was overheating. I'd be willing to bet that there's next to no wear.
All those parts look well overheated, same as mine were. They'll suggest that someone was driving badly and riding the clutch, which is a possibility of course. It'll be a difficult argument to win.

Certainly no apparent wear on the clutch plate, no shiny rivets that I can see in the pics, that's a sure sign of wear ?

right guys, I have to pay up as I want the van back lol, as I have more on my plate just now I will just swallow the cost and live an learn......not really much I can do apart from court and then who do I fight, the garage, marquise, the warranty supplier, better just paying and move on one question, what happens if it was not the clutch and the fault is still there? cheers for all advice guys

It looks very much as though it was the clutch Blu. If not the problem isn't fixed and they still have to fix it, unless it's more wear and tear. As to who pays for the clutch then, I guess that will have been you and it'll be hard to change that.
I think your pragmatic attitude is the right one, given that no fault has ever been admitted with the 3 litre. After mine had the new clutch I drove it as though the clutch was made of cheese, because the clutch is made of cheese.

I agree with Alan. Just pay and move on.
I would be mad as hell about it but you could end up a lot more out of pocket if you go down the Legal route.

Yes, best to "move on", blu. Sometimes life's too short. It's difficult to argue the toss on "wear items" like clutches (unless brand new to start with). You can knock yourself out arguing the toss, at great personal cost.
It's difficult to see the extent of any wear in the photos. Sure, the plate is grooved but you'd expect that anyway even on a still-serviceable item.
A different scenario if they've obliged you to have an unnecessary repair. You need an expert on your side to "argue the toss" for you. I repeat my earlier recommendation of a RAC/AA Vehicle Report. £90 well spent if it can save you heartache and even more wallet punishment in the future.
But let's hope this sorts whatever problem you had and you can concentrate on your girl.
