WTF! is it even illegal to be in possession of Viagra. he should have pled not guilty, it would never stand up in court.
The police said there was a rise in this sort of crime, but I thought 4 months was a stiff one!

The number who still need to grow up is fairly small and luckily getting smaller all the time, even though that may take several generations yet, Alan.

Surprise, surprise. Viagra is illegal except when supplied under prescription or dispensed by a specially trained pharmacist at Boots. Presumably then carrying a viagra tablet and being unable to demonstrate that it was prescribed for you is an offence. Sounds like a hooligan to me. They are everywhere. Dont even know why its big news. Im more shocked as to why a 19 year old needs Viagra in the first place. Perhaps thats why he was so angry.

I'm afraid that I have to disagree with you, Alan, as the possession of viagra without a prescription but which has not been stolen and with no intention of selling or supplying it is not an offence under the Medicines Act 1968 nor does it fall within the ambit of the Misuse of Drugs Act 1971 (both of which apply to Northern Ireland), nor is it an offence under any other legislation. However, many coppers are under the misapprehension that viagra is a controlled drug and that its possession per se without a prescription is an offence under either of these Acts . This point has been dealt with on the Police National Legal Database several times, and the answer always disappoints the police officers who ask it. Obviously there is more to this story than the facts report in the Belfast Telegraph, but the devil is in the (unreported) details, as they say.

Over the years I worked with a number of Irishmen from North and South of the border. Almost without exception they were very nice people. There was one from Leeds who lived up to the tradition that Irishmen are thick (and did a first class job of it). One other, a Belfast Protestant in a quite senior position and University educated was very bigoted. He made comments about missing the marching season and I pulled a face. He must have jumped to the conclusion I was RC and I had a hard time after that. I never told him where he was going wrong, people like that are best ignored (which I did).

It may well be the the Police and the DPP in Northern Ireland take the view that possessing viagra is illegal, regardless of what the law in the UK generally says. They have a long and dishonourable tradition of pleasing themselves as to what ridiculous charges they will apply. It comes from having been able to do as they like for donkeys years.
It is also worth nothing that laws passed in the UK, even if NI is included in their scope are not applicable till a Northern Ireland Enabling Order is applied. At times, for many reasons, no such order is passed and therefore laws are not enacted in NI.
I doubt the Belfast Telegraph would have reported the viagra charge unless it had been brought. Had it been dismissed it would have been an even better story and therefore would have been more widely reported, Alan.

Nothing to do with the OP but is it not about time that there was less dramatic reporting over events in NI? The war is over (for most) and last I heard things had improved and tourism was recovering. I used to travel to Belfast in the early 90's on business with a colleague. Things were a bit iffy then and Folk at home used to tell us "ooh dont go there, you will be killed to bits" Bollocks. We always had a great time and no bother although on the last day we were there I did see a building get stormed and the Europa where I was staying got blown up the day after I left. I did like that pub which was the oldest in town and still lit by gaslight. Just seems to me that wherever you are there are a minority who will try and fuck it up for everyone else. The NI folk I met were lovely.

Yes, you are correct, and I mistakenly overlooked the detailed provisions of the Misuse of Drugs (Designation) Order (Northern Ireland) 2001 and the Misuse of Drugs (Designation) (Amendment) Order (Northern Ireland) 2012 which may well be relevant to the instant case. However, I'm not being paid to do research any more, and the convicted clown felon is not going to pay me handsomely for developing a spirited defence for him at this late stage, so I don't give a toss, especially as I think whatever happened to the buffoon was deserved, regardless of whether possessing viagra is an offence in NI or not.
